A Carlow client settled his employer’s liabilty case in Dublin High Court. The client suffered a significant injury whilst lifting steel at work. He was sent by the Company to their Doctor who diagnosed soft tissue injuries. However the injury was a lot more substantial and following a MRI scan, disc damage was noted and surgery was required. The defendants argues that the client was out of time (statute barred) from taking his claim. Following a hearing before Mr Justice Quirk, the High Court decided the Plaintiff could bring his case out of time based on the misdiagnosis by the company Doctor, as well as the date of knowledge of the significance of the injury, which was only properly revealed following the MRI Scan. Following the case, settlement in the sum of €165,000.00 plus costs.
